1. GENERAL PROVISIONS

1.1. The Terms of Use (hereinafter – the Terms) of the National Library of Latvia (hereinafter – the NLL or the Library) prescribe the procedure by which the NLL as a public universal scientific library provides services, access to its collection, use of information resources, databases and systems, registration, the rights and obligations of readers, visitors and tourists. The Terms are binding on private persons who are in the NLL building and are binding until the moment when the private person leaves the NLL building, or when the obligations between the private person and the NLL cease to exist, if the particular individual has previously undertaken such.

1.2. The NLL reader (hereinafter – the Reader) may be any natural or legal person who wishes to use the information resources in the NLL collections – printed materials and other documents (audiovisual materials, manuscripts, etc.) or electronic publications, databases and systems, as well as receive printed materials and other documents or electronic publications or copies thereof from the collections of other Latvian and foreign libraries and document centres. Cooperation agreements on the provision of information services are concluded with legal entities.

1.3. Reader registration:

1.3.1. a reader is a person to whom a Reader's Card or a Reader's Card for Children has been issued;

1.3.2. only registered readers may use all NLL services;

1.3.3. readers are registered and the Reader's Card is made in the Client Service Centre (Welcome Desk) on the Level 1 of the library at Mūkusalas iela 3, Rīga;

1.3.4. The Reader's Card can be obtained from the age of 16;

1.3.5. The Reader's Card for Children can be obtained from the age of 5 to 15;

1.3.6. registration with the NLL is free of charge;

1.3.7. The validity of the Reader's Card is five years, and the validity of the Reader's Card for Children is three years.

1.4. When registering you need to:

1.4.1. present a passport or ID card [1];

1.4.2. fill in the registration form (see Annex 1 "Reader's Registration Form of the National Library of Latvia") and sign, thus confirming compliance with the Terms. The registration form can be completed online or in person;

1.4.3. when registering children and minors from 5 to 18 years of age:

1.4.3.1. the presence of parents or legal guardians or the written permission of parents or guardians appointed in accordance with the procedures specified in the laws and regulations is required (see Annex 2 "Permit Form for the Registration of Children and Minors as Readers of the National Library of Latvia");

1.4.3.2. children and minors must present a passport, ID card or other identity document with a photograph and personal identification number.

1.5. Visitors and tourists do not have to register as readers in accordance with the procedure laid down in Paragraphs 1.3 and 1.4 of these Terms. All visitors and tourists have the same duties and responsibilities as registered readers. If a person only wants to visit the Level 1 and Level -1 of the library, he/she does not need to register or receive the Visitor's Card or the Excursion Card.

1.6. Visitors and tourists are given the Visitor’s Card or the Excursion Card:

1.6.1. a person who has been issued a Visitor's Card may get acquainted with the NLL building individually or in a group of up to 10 people, attend various events (lectures, exhibitions, training, concerts, etc.) on the Level M, Level 2–8, Level 11–12;

1.6.2. the NLL collections cannot be used with the Visitor's Card. If the visitor wishes to use the NLL collections and receive other information services offered by the NLL, perform document copying or scanning, he/she must register as a reader in accordance with the procedure specified in Paragraphs 1.3 and 1.4 of these Terms.

1.6.3. with the Excursion Card, a person may only stay in the NLL building when accompanied by an NLL employee-guide.

1.7. The teacher in charge of groups of pupils must ensure at least one adult in each group, who takes care of compliance with the Terms and procedures during the visit to the library, including the event or excursion.

1.8. Visitors and tourists may use the computer at the Client Service Centre (Welcome Desk) to retrieve electronic information resources or make printouts for up to 15 minutes without registering in accordance with the procedure laid down in Paragraphs 1.3 and 1.4 of these Terms.

1.9. The Reader’s Card can also be used for payments by paying for the following paid services of the NLL: copying, printing, scanning of information, which are specified in the Cabinet Regulation "Price List of Paid Public Services of the National Library of Latvia" (hereinafter – the Price List). The payment procedure of the Reader's Card is determined by the internal regulations of the NLL "Terms of Payment Procedure of the NLL Reader's Card".

1.10. The Reader's Card gives children the opportunity to visit the Children’s Literature Centre, other reading rooms of the NLL and use the information resources in the NLL collections.

1.11. With the Reader's Card for Children, children under the age of 7 can only visit the NLL accompanied by a parent or a person replacing the parents.

1.12. With the Reader's Card for Children, children under the age of 10 can only visit the Audiovisual Reading Room and the Internet Reading Room accompanied by a parent or a person replacing the parents.

1.13. It is forbidden to transfer the Reader's Card and the Reader's Card for Children, as well as the Visitor's Card or the Excursion Card to another person.

1.14. Lost or found Reader's Card or Reader's Card for Children, as well as the Visitor's Card or the Excursion Card must be reported to the NLL employee or handed over to the Client Service Centre (Welcome Desk).

1.15. Renewal of the Reader's Card or the Reader's Card for Children is a paid service in accordance with the Price List:

1.15.1. if the card is lost;

1.15.2. if the personal identity number, name or surname of the reader has been changed;

1.15.3. if the reader wants to change the photo of the Reader's Card;

1.15.4. if the Reader's Card is damaged and it is not possible to determine the cardholder, or the specialised programs are unable to read the card information;

1.15.5. if the reader wishes to renew his/her Reader's Card after he/she has confirmed his/her wish to stop using the NLL services in writing.

1.16. The purpose of personal data processing is to provide and perform the services provided by the NLL to readers in accordance with the competencies specified in the laws and regulations of the Republic of Latvia.

1.17. The processing of personal data takes place as long as the data subject has not confirmed his/her desire to stop using the services provided by the NLL in writing. If the reader has violated the Terms, as a result of which material damage has been caused to the NLL, or other consequences have occurred, the further management of which is to be performed by the NLL; the personal data may be deleted 5 years after the last violation.

1.18. Information on the level of education acquired by the person, the acquired speciality and the educational institution is necessary in order for the NLL to be able to provide the content of the NLL collections corresponding to the content of readers and information and library services developed for a specific target audience.

1.19. Contact information (e-mail, telephone number) shall be used to communicate with the reader, for example, to inform about the provision of services. Information about a person's address is required for official communication, in cases when it is not possible to contact the reader using other contact information (e-mail or telephone), for example, if the reader is indebted to the NLL, or other matters related to the use of the NLL resources.

1.20. In aggregated form, the data are used to provide the national statistics specified in regulatory documents on the work of libraries with data on the NLL, research and to improve the quality of services.

1.21. The NLL and other libraries of national importance use the integrated library information system ALEPH 500 (hereinafter – ALEPH), together creating the Electronic Union Catalogue of Latvian Libraries of National Significance, which means that the basic data of the data subject is also available in libraries using ALEPH.

 

2. RIGHTS, OBLIGATIONS AND RESPONSIBILITIES OF THE LIBRARY READER

2.1. Rights of the reader:

2.1.1. to use the information resources in the NLL collections – printed materials and other documents (audiovisual materials, manuscripts, etc.), or electronic publications, information systems, databases, as well as inventory and equipment available at the NLL;

2.1.2. receive the printed materials and other documents or electronic publications or copies thereof from the collections of other Latvian and foreign libraries and document centres for on-site reading in accordance with the procedures specified by the NLL;

2.1.3. receive information regarding the NLL collections, reading rooms, databases and information regarding printed materials and other documents or electronic publications and the procedure for issuing them;

2.1.4. receive consultations and training services regarding the search for information specified in Paragraph 2.1.3 of these Terms;

2.1.5. receive paid services in accordance with the Price List;

2.1.6. use the internet in accordance with the procedure specified in Chapter 6 of the Terms "Other Terms Related to the Use of the NLL";

2.1.7. bring and use personal effects (stationery, wallets, glasses, medicines for personal use, basic hygiene items, water in the original packaging or transparent bottle), books and other printed materials, documents or electronic publications, as well as laptops and other electronic devices in specialised protective covers;

2.1.8. enter with a stroller with a child in it and a bag with the hygiene goods necessary for the child, the child's food and clothing;

2.1.9. people with mobility impairments/disabilities, having difficulty moving with the special NLL folders/bags, in exceptional cases, when the decision is made in the Client Service Centre (Welcome Desk) after assessing the situation, are allowed to enter with a personal bag, which must be opened and presented to a security guard upon entry and exit;

2.1.10. photograph the materials of the NLL collections for non-commercial purposes without a flash, in coordination with the reading room staff;

2.1.11. make suggestions and reprimands regarding the work of the NLL and NLL employees;

2.1.12. in accordance with the Price List, use the NLL self-service document reproduction technique or order the making of copies (see Annex 3 "Order Form for Making Copies"), printing of information (from a computer) and digitisation;

2.1.13. during the opening hours of the library and during events to receive a reduced rate for the service of the NLL car park at Mūkusalas iela 5 in accordance with the internal rules "Terms of Use of the Paid Car Park of the National Library of Latvia". The reduced rate must be arranged at the Client Service Centre (Welcome Desk) during the library's opening hours. Cash payments can also be made there.

2.2. The reader has the duty and responsibility to:

2.2.1. when visiting the National Library of Latvia, always take your Reader's Card with you and register it when going through the electronic gate. If the reader forgets to take the Reader's Card, he or she shall be admitted to the library by presenting a passport or ID card. If the reader forgets to take the Reader's Card with him/her again, a new card shall be issued to him/her for a fee in accordance with the procedure specified in Paragraph 1.15 of the Terms;

2.2.2. Update your reader's account in the Client Service Centre (Welcome Desk) every calendar year;

2.2.3. treat the NLL printed materials and other documents (audiovisual materials, manuscripts, etc.) or electronic publications, inventory, equipment and expositions with care;

2.2.4. pay a fee for a lost printed material or other document and reimburse the value of the lost printed material or other document in accordance with the Price List;

2.2.5. pay a fee for damaged printed material or other document and reimburse the value of the damaged printed material or other document in accordance with the Price List;

2.2.6. after their use, place printed materials and other documents of the open access collection in a place specially provided for them or hand them over to an NLL employee;

2.2.7. return printed materials and other documents received from the NLL repositories to the NLL employee at the places of issue of printed materials and other documents;

2.2.8. inform the NLL employee about damage noticed in printed materials and other documents, electronic publications or technical devices;

2.2.9. comply with the Copyright Law when using, copying or scanning the information resources in the NLL collection;

2.2.10. treat the NLL staff, readers, visitors and tourists with respect, follow the instructions of the NLL staff or security guards;

2.2.11. bring personal belongings in accordance with Paragraph 2.1.7 of these Terms without bags, only in the special NLL folders/bags provided for that purpose, which can be received in the NLL wardrobe, except for exceptional cases based on the procedure specified in Paragraph 2.1.9 of these Terms;

2.2.12. when passing through the electronic gate, your personal laptops and other electronic devices must be removed from the NLL special folders/bags and carried in the hands;

2.2.13. pay the cost of a lost wardrobe token or wardrobe key in accordance with the Price List;

2.2.14. only use the coin changer to exchange money to lock the wardrobe locker.

2.3. In the case of non-compliance:

2.3.1. The staff of the Client Service Centre (Welcome Desk) and/or security guards may deny the reader/visitor/tourist access to the NLL;

2.3.2. The NLL employees and/or security guards may warn the violator orally when they first find a violation of the Terms;

2.3.3. In the case of non-compliance with the Terms, a report on a violation of the Terms is drawn up. The reader is warned that in the case of repeated non-compliance with the Terms, he/she shall be expelled from the NLL and will be denied any stay on the NLL premises;

2.3.4. if the reader or visitor refuses to sign regarding getting acquainted with the content of the act, he or she shall not be released from liability for the violation;

2.3.5. in the case of repeated non-compliance with the Terms, the reader shall be expelled from the NLL for a period of up to one year. In the case of repeated non-compliance with the Terms, the reader shall be expelled from the NLL for a period of up to three years;

2.3.6. if there is a reasonable suspicion that the reader in the NLL building may have committed a criminal offence or administrative violation, or is possibly preparing to commit them, this reader may be expelled from the NLL building or excluded from the NLL reader register for a period of up to three years;

2.3.7. if the reader/visitor/excursionist is on the library premises under the influence of alcohol or other intoxicating substances, behaves aggressively and/or threatens the NLL staff, he/she must immediately leave the NLL premises accompanied by a security guard. Security guards may be asked to measure the concentration of alcohol in the exhaled air using an breathalyser. The test is performed with the verbal consent of the person being tested. If a person does not agree to the alcohol concentration test, it shall not release him/her from the obligation to leave the premises of the NLL;

2.3.8. for being in the premises of the NLL under the influence of alcohol or other intoxicating substances, or their use in the premises of the NLL, as well as aggressive behaviour, the reader shall be expelled from the NLL without warning for one year.

2.4. Readers and visitors are not allowed to:

2.4.1. enter in outerwear, bring bags of any size or type (handbags, backpacks, briefcases, etc.) except for the personal belongings and cases with musical instruments referred to in Paragraphs 2.1.7 and 2.1.8 of the Terms, which must be presented to the Client Service Centre (Welcome Desk) or security staff before and after passing through the electronic gate;

2.4.2. bring and use food, alcoholic and non-alcoholic beverages and other intoxicating substances, except for water referred to in Paragraph 2.1.7 of these Terms in the original packaging or in a transparent bottle;

2.4.3. disturb the work and location of NLL employees, other readers, visitors and tourists on the NLL premises, sleep on the NLL premises;

2.4.4. make offensive remarks, comments and threats to NLL employees, security guards and other readers, visitors and tourists;

2.4.5. stay in unhygienic, smearing and smelly clothing, under the influence of alcohol and/or other intoxicating substances;

2.4.6. smoke indoors, including electronic cigarettes;

2.4.7. work with printed materials and documents with wet, dirty hands, as well as make marks therein or in any other way damage printed materials and other documents;

2.4.8. use mobile devices and personal computers for conversations and music playback in reading rooms and exhibition halls in a manner that creates noise or otherwise disturbs other readers and visitors, as well as personal scanners, dictaphones, printers;

2.4.9. all electronic devices brought into the reading rooms and exhibition halls must be turned to silent mode, the use of the headphones must not be audible or disturbing to others;

2.4.10. enter with animals (except with trained guide dogs, assistant dogs and service dogs together with the employees of the Security Service);

2.4.11. bring in weapons, explosives or objects or substances which, due to their nature, cause damage to the life or health of persons, if their introduction is not related to the performance of official or work duties, and there are no other objective reasons for bringing such objects.

 

3. RIGHTS, OBLIGATIONS AND RESPONSIBILITY OF THE LIBRARY

3.1. Video surveillance is carried out on the premises of the NLL for the purposes of the detection of criminal offences, protection of property and vital interests of persons. The video surveillance manager is the NLL, but the operator is a company that has entered into an agreement with the NLL on the provision of physical security services.

3.2. NLL shall not take responsibility for personal belongings, including bicycles, which are left unattended on the NLL premises and outside the NLL building.

3.3. Within the opening hours of the NLL, it is possible to leave the personal belongings of readers, visitors and tourists in a room with closed lockers or in the wardrobe.

3.4. Readers, visitors and tourists must remove their personal belongings from the lockers by the end of the NLL opening hours. After the closure of the library building, the staff of the Client Service Centre (Welcome Desk) or security guards shall inspect the locked lockers and remove the leftover belongings, which are stored for three months from the date of their finding. At the end of the storage period, the abandoned property shall be handed over to the competent authority. If the items left in the lockers are foodstuffs, objects or substances which, by reason of their nature, cause damage to the life, health or property of persons or are perishable, such items shall be handed over to the competent authority or destroyed.

3.5. If there are reasonable suspicions of non-compliance with the Terms, the NLL and the security guard may request to present the Reader's, Visitor's or Excursion Card and request to open and present the NLL folder/bag with personal belongings, musical instrument case or bag with baby food, clothing and hygiene items.

3.6. The NLL may close the NLL building at any time, preventing visitors to the NLL building from entering the building or its separate parts, if necessary to protect national security, prevent or detect criminal offences or administrative violations, provide services, enter into contracts, ensure planned or other measures or to take measures of a technical or organisational nature.

3.7. Procedure for issuing and receiving printed materials and other documents or electronic publications at the disposal of the NLL:

3.7.1. printed materials and other documents (audiovisual materials, manuscripts, etc.) are issued for use on site in the reading rooms of the NLL only. The procedure for the remote use of digital materials is specified in Chapter 6 of these Terms "Other Terms Related to the Use of the NLL";

3.7.2. printed materials and other documents can be received by the reader in the reading rooms or at the Book Issuing point of the Repository, ordering them electronically – both remotely and on the NLL premises. Editions from the Open Access Collection can be used in reading rooms based on self-service or pre-booking;

3.7.3. no more than 10 units of printed materials and other documents or electronic publications, including five units of the Periodical Collection, shall be issued to the reader at the same time;

3.7.4. it is permitted to work with editions from the Open Access Collection in any reading room, by registering them with the reading room employee before taking them out of the reading room;

3.7.5. printed materials and other documents ordered from repositories shall be stored on the reservation shelves of reading rooms for 3–10 days;

3.7.6. when booking printed materials and other documents from the Open Access Collection, the reader must arrive to pick up the reserved material within one day. If the reserved printed materials and other documents are not used within the specified period, the reservation shall be cancelled;

3.7.7. reference literature and frequently requested printed materials and other documents shall not be reserved from the Open Access Collection;

3.7.8. the reader can receive the printed materials or other documents ordered from the repositories at Mūkusalas iela 3, Rīga within 30 minutes. Printed materials and other documents from the Repository in Silakrogs are delivered to the NLL building at Mūkusalas iela 3, Rīga twice a week (once a week in July and August);

3.7.9. the reader may order printed materials and other documents from other Latvian and foreign libraries, using the services of the Interlibrary Subscription or the International Interlibrary Subscription in accordance with the terms of their use specified in Chapter 5 of these Terms "Terms of Use of NLL Loans";

3.7.10. The Personal Loan may be used in accordance with the Terms of Use of the Personal Loan specified in Chapter 5 of these Terms "Terms of Use of the NLL Loans";

3.7.11. The procedure for the use of special collections shall be determined by the Terms of Use of Special Collections, which are specified in Chapter 4 of these "Terms of Use of Certain NLL Collections";

3.7.12. The procedure for the issue of a legal deposit shall be determined by the Terms of Use of the NLL Archival Copies, specified in Chapter 4 of these terms "Terms of Use of Certain NLL Collections";

3.7.13. The procedure for the issue and use of periodicals shall be determined by the Terms of Use of Periodical collection, specified in Chapter 4 of these Terms "Terms of Use of Certain NLL Collections";

3.7.14. The reader can order copies of the copies of the People's book shelf on the website https://tautasgramatuplaukts.lv/en/. The ordered printed materials shall be issued on Tuesdays for reading in the library reading rooms only.

3.8. At the end of the working day:

3.8.1. after the first signal of the end of opening hours, which sounds 15 minutes before the closing of the library, the used printed materials and other documents must be handed over, and the reader must leave the premises of the NLL;

3.8.2. reader registration shall be terminated half an hour before the end of the NLL opening hours;

3.8.3. the opening hours of the cash desk shall end 10 minutes before the end of the NLL opening hours;

3.8.4. the wardrobe and the room for storing belongings with closed lockers shall be closed ten minutes after the end of the NLL opening hours.

 

4. TERMS OF USE OF INDIVIDUAL NLL COLLECTIONS

4.1. Terms of Use of Special Collections [2] include requirements that only apply to Special Collections:

4.1.1. Special Collections – printed materials and other documents (audiovisual materials, manuscripts, etc.) from the Special Collections repositories can only be used in the Special Collections reading rooms or in specially equipped premises (group lessons, piano rooms). Printed materials and other documents from the Open Access Collection of the Special Collections may be taken to other reading rooms of the National Library of Latvia, having previously registered them with an employee of the Special Collections Reading Room. At the end of the work, the issued printed materials and other documents must be returned to the reading rooms of the Special Collections;

4.1.2. Materials of the Collection of Rare Books and Manuscripts (hereinafter – Rarities) and the Baltic Central Library (hereinafter – BCL) are only available to readers in the presence of the bibliographer on duty in the reading room. To receive these materials, the readers shall submit a written or electronic request. The reader may receive no more than 10 collection items. Depending on the condition of the material, the number of items to be issued may be limited, or the issue of an item may be refused for the purpose of conserving the material, or if the material has been deposited. The issue of the materials to readers is stopped 30 minutes before the end of the reading room's opening hours;

4.1.3. Images (postcards, posters, prints, ex-libris, drawings, photographic materials) in the Special Collections of Art Reading Room shall be issued by applying for a visit in advance by contacting Art Reading Room in person by phone or e-mail;

4.1.4. printed materials of the Special Collections booked by a reader and other documents from the repository in the Special Collections reading rooms – Music Reading Room, Audiovisual Reading Room, Art Reading Room, Lettonica and Baltic Reading Room, Maps Reading Room and Small Printed Items Reading Room – shall be stored on a shelf of reserved works for up to five days, and printed materials from the Open Access Collection no longer than one day;

4.1.5. Rare and BCL materials shall be reserved for the reader for a period of up to one month from the date of receipt of the request. The materials are checked by the reading room employee upon receipt;

4.1.6. due to the specific location of the collection, large-scale printed materials of the Special Collections and other documents (manuscripts, etc.) may be issued on the next day;

4.1.7. Printed materials and other documents for reading rooms of the Special Collections shall not be issued for home use, except for in the cases where they comply with the "Terms of Use of Personal Loan" specified in Chapter 5 of these Terms "Terms of Use of NLL Loans";

4.1.8. Audiovisual reading booths are designed for the use of the Audiovisual Collection [3]. The specialised hardware and software available in the Audiovisual Reading Room is intended for use directly with the software on the computers. Audiovisual Reading Room’s staff may check that computers are being used for their intended purpose. If it is established that the computer equipment is not used for the specified purpose, the NLL staff may deny the reader the use of the computer;

4.1.9. the reader shall sign for the issue of the Special Collections printed materials and other documents with special cultural and historical value (manuscript originals, rarities, photographs, etc.) in the issue log of the relevant reading room of the Special Collections, assuming responsibility for the issued printed materials and other documents in accordance with the procedure specified in Paragraph 2.1.2 of these Terms; the issue of re-catalogued Rarity units shall be recorded electronically without the need to sign the issue log;

4.1.10. Copying and/or scanning of Special Collections – printed materials and other documents shall be a paid service in accordance with the Price List and shall be performed by ensuring the preservation of Special Collections specified in the Library Law and other laws and regulations as a particularly valuable set of national and historical materials, therefore the reader must coordinate it with the collection reading room staff:

4.1.10.1. Photocopies and electronic copies of rarities and BCL texts, images and cartographic materials shall only be made at the request of the reader (see Annex 4 "Order Form for Making Copies of the Special Collections Materials"). For the production of photocopies and electronic copies of other Special Collections materials, an employee of the NLL may make a decision to make such a request in writing using said form. Before making copies, the reading room employee makes sure and decides whether the technical condition of the collection materials allows copying. Copies of materials are made within five working days (or by agreement with the reader on another term), if the volume of the order does not exceed 50 pages. If the volume of the order exceeds 50 pages, the time of execution of the order and delivery shall be agreed with the reader;

4.1.10.2. Small-scale photography (up to 10 frames) of the Special Collections materials without the use of a flash shall be permitted for readers in agreement with the on-call bibliographer and is free of charge. Re-photography of the manuscript collection or printed materials from any Special Collections stock in full shall be prohibited. Readers are responsible for respecting the copyright of the materials used.

4.1.11. The Audiovisual Reading Room may be used to make copies of audiovisual material (sound and video recordings) in the Audiovisual Repository for which copyright protection has expired, as well as of copyrighted works, if the reader has received a permit of the collective management organisation (AKKA-LAA) and the related rights collective management organisation (LaIPA) or the right holder, according to the type of the relevant material, and may provide proof of authorisation. Making copies of the Audiovisual Collection is a paid service in accordance with the Price List. The standard execution time of the copy production service shall be five working days, and the service is provided on the basis of a reader's application for the reproduction of audiovisual materials in the NLL collections (see Annex 5 "Application for the Reproduction of Audiovisual Materials in the NLL Collection");

4.1.12. the reader shall be responsible for the printed materials and other documents or electronic editions of the Special Collections issued to him/her and for their return in the same order and condition as they were issued. The reader shall immediately inform the NLL employee about noticed damage;

4.1.13. When using the materials of the NLL Special Collections in scientific research work and public events (conferences, exhibitions, websites, etc.), readers must indicate the location of the original. When the source is first mentioned, the full name of the storing party and the repository code number must be provided: NLL Collection of Rare Books and Manuscripts, R [repository code No.], NLL Baltic Central Library, BCL [repository code No.]. For repeated reference: NLL R [repository code No.], NLL BCL [repository storage code No.] Examples of references: Printed materials: RL2/252. Periodicals: Rp. Cartographic materials: KtL1-1/55. 4.2. Terms of use of the archival copies [4] shall specify the requirements that only apply to archival copies:

4.2.1. Archival copies in the NLL collection shall only be issued and available in the reading rooms of the NLL, in the reading room of the collection responsible for the respective archival copy to the NLL employees in a transparent area during the opening hours of this collection/department;

4.2.2. the request for reservation of an archive copy may only be completed in person at the NLL (see Annex 6 "Application for Receipt of the Archival Copy of the National Library of Latvia");

4.2.3. before issuing the archival copy, readers shall be offered the opportunity to use a digital copy of the archival copy (if such is already available);

4.2.4. if it is established that an analogue copy of a printed material or other document ordered from the archive of the legal deposit is in another library of Rīga, issuance of the ordered copy to the reader is refused. The reader shall be informed about the location of the analogue copy or the reasons for not issuing it in person or in a letter sent to the e-mail specified by the reader when registering at the NLL;

4.2.5. for the issued archival copies, the reader shall sign the issue of each specific collection of the National Library of Latvia in the journal or application submission, assuming responsibility for the issued archival copies in accordance with the procedure specified in Paragraph 2.2.2 of these Terms;

4.2.6. Archival items in the NLL collection, if the archival publication is the only copy in the NLL collection and no digital copy is available to it, shall only be issued to readers for research purposes;

4.2.7. archival items shall only be issued in person in the NLL reading rooms to the users of the Personal Loan and Interlibrary Loan;

4.2.8. copies of archival items (including digital copies) shall only be made by the NLL employees responsible for the collection or digitisation or copying specialists upon the reader's prior application in accordance with the Price List, ensuring the preservation of the archival items as a particularly valuable set of national and historical materials specified in the Library Law and other laws and regulations;

4.2.9. the reader shall be responsible for the printed materials of archival items and other documents (audiovisual materials, manuscripts, etc.) issued to him/her and for their return in the same order and condition as they were issued. The reader shall immediately inform the NLL reading room employee about noticed damage.

4.3. Terms of Use of the Periodical Collection [5] shall set out the requirements that only apply to the Periodical Collection:

4.3.1. five items of the Periodical Collection shall be issued to the reader at the same time;

4.3.2. printed materials from the Periodical Open Access Collection and large format (A2, A3) newspaper sets can only be used in the Periodical Reading Room;

4.3.3. the issued printed materials may only be taken out of the Periodical Reading Room with the permission of the reading room employee. At the end of the work, the issued printed materials must be returned to the Periodical Reading Room;

4.3.4. readers may only order the Periodical Collection items electronically:

4.3.5. For the purposes of preserving the Periodical Collection, ensuring the preservation of the Periodical Collection specified in the Library Law and other laws and regulations as a particularly valuable set of national and historical materials of national significance; the original digitised periodicals and periodicals in very poor physical condition of the Periodical Collection shall not be issued to readers;

4.3.6. Originals of periodicals of the Periodical Collection, which have been digitised for preservation purposes, shall be issued and copies made only for research work with the permission of the NLL administration upon request, ensuring the preservation of the Periodical Collection specified in the Library Law and other laws and regulations as a particularly valuable set of national and historical materials of national significance (see Annex 7 "Order Form for Making Copies of the Original Digitised Periodicals of the National Library of Latvia" and Annex 8 "Order Form for Issuing the Original Digitised Periodicals of the National Library of Latvia");

4.3.7. In order to preserve the Periodical Collection, by ensuring the preservation of the Periodical Collection specified in the Library Law and other laws and regulations as a particularly valuable set of national and historical materials of national significance, readers shall be prohibited from making themselves any copies of large format (A2 and A3) publications of the Periodical Collection. Large format (A2 and A3) copies of the Periodical Collection can be ordered:

4.3.7.1. by using the NLL service “Digitisation on Demand” – scanning the document and sending it to the reader to the e-mail address indicated by the reader. The term of provision of the service shall be five working days;

4.3.7.2. by using the NLL copying service, which is performed by the NLL copying specialist, and the execution term shall be two to three working days;

4.3.8. arbitrary making of copies of large-format newspapers (A2 and A3) of the Periodical Collection shall be considered a violation of these Terms, for which the liability provided for in Chapter 2 "Rights, Duties and Responsibilities of the Library Reader" shall be applied;

4.3.9. the reader shall be responsible for the editions of the Periodical Collection issued to him/her and for their return in the same order and condition as they have been issued. The NLL reading room employees shall be immediately informed about noticed damage.

 

5. TERMS OF USE OF THE NLL LOANS

5.1. Terms of Provision and Use of the Interlibrary Loan (ILL) [6] and the International Interlibrary Loan (IILL) services [7] shall set out the requirements that only apply to the ILL and IILL:

5.1.1. ILL and IILL services shall be provided by the Information Services and Interlibrary Loan Department of the Reference and Information Centre, ensuring the receipt and sending of printed materials and other documents or electronic publications within the ILL and IILL system;

5.1.2. The provision of the ILL service shall be available to the libraries and other legal entities of the Republic of Latvia by concluding a cooperation agreement with the NLL;

5.1.3. Printed materials and other documents or electronic publications in the NLL collection can be ordered by using the ILL:

5.1.3.1. A librarian of the library of the Republic of Latvia, a librarian of Latvian state concert organisations or an employee responsible for sheet music (free subscription);

5.1.3.2. Other legal entities, including companies and non-governmental organisations (paid subscription according to the Price List);

5.1.4. The ILL order can be placed by using the electronic joint catalogue or by filling in the application for ordering publications from the scanned card catalogues on the NLL website;

5.1.5. Provision of the IILL service:

5.1.5.1. IILL service shall only be available to NLL readers;

5.1.5.2. using the IILL service, you can order printed materials, copies of printed articles, as well as other documents or electronic publications from foreign libraries and document delivery centres that are not available in the NLL collection, NLL subscribed databases and other Latvian libraries (see Annex 9 "Order Form for the Receipt of the International Interlibrary Loan Service"), subject to the regulations of the library from which the publications are ordered;

5.1.5.3. The IILL service shall be a paid service according to the Price List;

5.1.6. Terms of use of the received ILL and IILL printed materials and other documents or electronic publications:

5.1.6.1. Printed materials and other documents or electronic publications ordered based on ILL shall be issued to libraries for one month, copies of reading rooms for two weeks; the term of issue to the Latvian state concert organisations shall be determined by agreement. Printed materials and other documents sent within the framework of the ILL service must be used in the library of the recipient of the ILL on site, and for Latvian state concert organisations, at the sites of concert rehearsals and concerts. Printed materials and other documents sent and received as part of the ILL service shall not be issued for home reading. The ILL recipient library shall be responsible for any damage to or loss of materials sent;

5.1.6.2. Printed materials and other documents received by IILL may be used for a period of up to three weeks in the ILL reading room only, unless the library that has lent the printed matter and other documents or electronic publications has set a different deadline. Printed materials and other documents sent and received as part of the IILL service shall not be issued based on the Personal Subscription. The IILL recipient library shall be responsible for any loss or damage to the materials sent;

5.1.6.3. for printed materials and other documents not delivered on time, the ILL subscriber of the relevant library shall pay a late fee for each day of delay in accordance with the Price List;

5.1.7. The following shall not be issued within the scope of the ILL and IILL services:

5.1.7.1. archival, Lettonica and special items of the printed materials and other documents;

5.1.7.2. frequently requested printed materials and other documents;

5.1.7.3. rare and valuable printed materials, reference publications and other documents (audiovisual materials, manuscripts, geographical maps, etc.);

5.1.7.4. printed materials and other documents issued before 1940;

5.1.8. The Latvian state concert organisations, by concluding a mutual agreement with the NLL (see Annex 10 "Application for Receiving Permission to Use the Archive Materials, Unique Copies and Orchestral Scores from the Music Reading Room of the National Library of Latvia to Ensure Concerts of the Latvian National Concert Organisations"), may receive the archive materials of Latvian composers, unique copies and orchestral scores with voices to ensure concerts, for use within the scope of the ILL service.

5.2. Terms of Use of the Personal Loan [8] shall set out the requirements that only apply to the Personal Loan:

5.2.1. The Personal Loan shall be granted at the Book Issuing point on the Level 2 of the NLL building;

5.2.2. Personal Loan services are offered at the Book Issuing point, branch literature reading rooms and Special Collections reading rooms;

5.2.3. The following categories of persons are entitled to receive the printed materials and other documents or electronic publications in the NLL collection for use outside the NLL building for a fee in accordance with the Price List:

5.2.3.1. the Saeima (Parliament) deputies and members of the government;

5.2.3.2. researchers;

5.2.3.3. academic staff of higher education institutions and teachers of educational institutions;

5.2.3.4. doctoral students;

5.2.3.5. representatives of creative professions who have been issued a creative person's certificate or a certificate certifying the status of a creative person;

5.2.3.6. lifelong scholarship holders of the State Culture Capital Foundation of Latvia;

5.2.3.7. students of master’s programmes of the higher education institutions for a period of up to 12 months for the development of a master's thesis, by submitting confirmation from the higher education institution, indicating the topic of the master's thesis;

5.2.3.8. NLL industry experts and cooperation partners;

5.2.4. In accordance with the Price List, the pupils and students of Latvian secondary and higher music education institutions may receive the music sheets in the collection of the Music Reading Room for a fee in accordance with the Price List;

5.2.5. paid Personal Loan shall be granted for six months or a year (see Price List);

5.2.6. free Personal Loan service available:

5.2.6.1. NLL employees after the probation period in accordance with the NLL internal rules;

5.2.6.2. Honorary readers of the National Library of Latvia;

5.2.6.3. by the decision of the NLL administration to the readers specified in Paragraphs 5.2.8.1, 5.2.8.2 and 5.2.8.3 of these Terms;

5.2.7. The NLL administration may grant a free Personal Loan in the exceptional cases specified in Paragraph 5.2.8 of these Terms. In order to receive the free Personal Loan service, the reader shall submit a free-form application to the NLL administration regarding the granting of a free Personal Loan. After evaluating the application, the NLL administration shall confirm the granting of a free Personal Loan or issue a refusal to the reader;

5.2.8. by the decision of the NLL administration, a free Personal Loan can be granted to certain categories of readers:

5.2.8.1. long-term readers who regularly visit the NLL and who in the current situation have social conditions that prevent the use of the Personal Loan paid service, by granting a free Personal Loan for a period of up to one year, accordingly providing for the possibility to renew the subscription every year;

5.2.8.2. in special cases, if the reader needs printed materials and other documents in the process of education or studies, or for scientific work, but due to disability or long-term illness is not able to visit the NLL;

5.2.8.3. exceptionally, in special cases, to the readers as gratitude for their active involvement in the activities of the NLL;

5.2.9. The following is necessary to apply for a Personal Loan:

5.2.9.1. present a passport or ID card;

5.2.9.2. fill in the Personal Loan Form (see Annex 11 "Application for Receipt of Personal Loan of the National Library of Latvia");

5.2.10. if the reader does not observe the term for delivery of the issued printed materials and other documents, the Personal Loan shall not be extended;

5.2.11. for the Personal Loan user to receive printed materials and other documents from the NLL collection:

5.2.11.1. they must be ordered electronically;

5.2.11.2. a request form must be filled in if the printed material or other document is not in the electronic joint catalogue;

5.2.12. A maximum of five units of printed materials and other documents shall be issued to the user of the Personal Loan at the same time;

5.2.13. In respect of the user of the Personal Loan:

5.2.13.1. the term of use of the issued printed material and other document shall be from two weeks to one month;

5.2.13.2. for printed materials and other documents, an individual term of use may be set by agreement with the user of the Personal Loan;

5.2.13.3. the term for issuing printed materials and other documents may be extended remotely in your Personal Loan user profile, not exceeding the total usage period of 60 days for the printed materials and other documents issued at the Book Issuing point (if no edition is in demand) and of 30 days for printed materials and other documents issued in reading rooms;

5.2.13.4. if the reader wishes to extend the issued printed materials or other documents repeatedly after the expiration of the deadlines specified in Paragraph 5.2.13.3 of these Terms, the printed materials and other documents issued must be presented in person to the employees of the Book Issuing point or the specific reading room;

5.2.14. The following shall not be issued to the user of the Personal Loan:

5.2.14.1. an archival copy of the legal deposit;

5.2.14.2. A special copy of the Special Collections;

5.2.14.3. frequently requested printed materials and other documents;

5.2.14.4. copies of rare and valuable printed materials and other documents in the collection;

5.2.14.5. printed materials and other documents in the collection issued before 1940;

5.2.14.6. printed materials and other documents from Special Collections reading rooms;

5.2.15. The user of the Personal Loan shall:

5.2.15.1. treat the received printed materials and other documents with care;

5.2.15.2. observe the terms of use of the received printed materials and other documents;

5.2.15.3. pay a late fee in accordance with the Price List for the Personal Loan printed materials and other documents not delivered on time;

5.2.15.4. The reader of the Personal Loan shall be responsible for the printed materials and other documents issued to him/her and for their return in the same order and condition as they were issued. The employees of the Book Issuing point or the specific reading room must be immediately informed about noticed damage;

5.2.16. if the reader systematically does not follow the procedure for issuing printed materials and other documents or electronic publications, the Personal Loan shall only be closed and renewed after the fulfilment of all obligations;

5.2.17. if the reader has lost the received printed materials and other documents or electronic publications, a fee must be paid and the value of the lost printed materials or other document must be reimbursed in accordance with the Price List;

5.2.18. if the reader has damaged the printed material or other document, a fee must be paid and the value of the damaged printed matter or other document must be reimbursed in accordance with the Price List.

 

6. OTHER PROVISIONS RELATED TO THE USE OF THE NLL

6.1. The Terms of Use of Public Computer Systems and the internet shall determine the requirements that only apply to the use of Public Computer Systems and the Internet:

6.1.1. The Terms of Use of Public Computer Systems and the Internet shall determine the procedure for the use of the Public Computer Systems (computers, monitors, printers, copiers, scanners, etc.) and the Internet in order to ensure the safe and reliable use of these resources at the NLL;

6.1.2. the readers are provided with free access to the internet and publicly available electronic information resources, as well as provided with the opportunity to use the computers of the Public Computer System free of charge;

6.1.3. when starting to use the infrastructure of the Public Computer System and the internet (including WiFi), the reader confirms that he/she has read these Terms;

6.1.4. free internet service time can be booked for a maximum of one hour. In coordination with the NLL employee, the reader may continue working on the computer for another hour, with the possibility to extend it, or until further instructions from the NLL employee;

6.1.5. the reader is allowed to use his/her information carriers (USB memory cards, USB external hard disks, CDs) for data recording;

6.1.6. when using the public computer system infrastructure (public computers, copiers, printers, scanners, etc.), the reader must follow the instructions for use of the specific hardware manufacturer, which can be found at the NLL public computers, copiers, printers, scanners, etc.;

6.1.7. if the reader, by using the infrastructure of the Public Computer System and the Internet, uses its own hardware (for example, personal computer, smartphone, tablet computer, etc.), he/she shall assume unlimited responsibility for the use of the software used in this hardware in accordance with the laws and regulations;

6.1.8. The user shall be prohibited to:

6.1.8.1. turn the NLL computers on and off;

6.1.8.2. damage or modify the infrastructure of the Public Computer System in any way, for example, it is prohibited to perform any type of installation (programs, games, etc.), change the configuration of the computer of the Public Computer System, including the program interface (appearance, "hotkey", etc.) settings, disconnect or connect wires to the computer of the Public Computer System and its peripherals, except for the wires required for connecting flash memory, portable hard drives or headphones, etc.;

6.1.8.3. use the internet and the infrastructure of the Public Computer System for committing violations of a criminal, administrative or civil nature specified in the legislation of any jurisdiction in the field of information environment. Examples of such activities include illegal business, copyright infringement, fraud, unauthorised credit card storage, and the storage or distribution of private information;

6.1.8.4. use the internet and the infrastructure of the Public Computer System to violate the security of national or international electronic communications networks, electronic services or information systems. Examples of security breaches include hacking into national or international information systems, scanning ports, unauthorised monitoring, use or various attacks on an information system, distributing viruses or other malicious software, altering unauthorised websites or other information;

6.1.8.5. use the internet and the infrastructure of the Public Computer System to transmit or store information containing threats, including threats to retaliate, kill or physically affect;

6.1.8.6. use the internet and the infrastructure of the Public Computer System to view, store or transmit illegal information, such as pornographic material, racial hatred, riot, coup d'état, etc.;

6.1.8.7. use the internet and the infrastructure of the Public Computer System to play computer games;

6.1.8.8. use the internet and Public Computer System infrastructure to transmit unsolicited e-mail (SPAM) and/or to maintain websites associated with such e-mail;

6.1.8.9. be at the computer of the National Library of Latvia with food, outerwear, as well as wet, dirty or otherwise soiled hands, as well as smear or damage the computers and their equipment in any other way;

6.1.9. the reader shall report violations of these Terms to the employees of the NLL by e-mail welcomedesk@lnb.lv or by calling the NLL security by phone 67806112.

6.2. Terms of Use of the Digital Library set out the requirements that only apply to the Digital Library:

6.2.1. Printed materials and other documents included in the digital library or

6.2.1.1. publicly available – printed materials and other documents or electronic publications are available worldwide from any computer with internet access;

6.2.1.2. available in the NLL and other state and local government libraries – printed materials and other documents or electronic publications in respect of which copyright is valid, and which in accordance with Section 23, Paragraph two of the Copyright Law are only available from public computers of the NLL and other state and local government libraries);

6.2.2. Procedure for using the digital library:

6.2.2.1. it is possible to register as a Digital Library reader by creating a Digital Library reader account on the NLL website or by logging in to the Digital Library system with one of the virtual identity verification methods offered in the internet environment;

6.2.2.2. Digital library printed materials and other documents or electronic publications can also be viewed or downloaded without registration or authorisation as a Digital Library reader;

6.2.2.3. it is necessary to register as a reader of the Digital Library in order to use certain services of the Digital Library, such as saving search results, correcting text recognition (OCR) errors occurring in the digitisation process, rating, commenting, etc.;

6.2.2.4. The NLL guarantees the confidentiality of personal data provided by the Digital Library reader during the registration or connection process;

6.2.3. copyright issues related to the works included in the Digital Library:

6.2.3.1. The copyright of the works included in the digital library belongs to the copyright holders (authors or their successors) of printed materials and other documents or electronic publications. Registered and unregistered readers of the digital library shall respect the rights of copyright holders in accordance with the provisions of the Copyright Law;

6.2.3.2. Registered and unregistered readers of a digital library may download non-copyrighted printed materials and other documents or electronic publications, as well as printed materials and other documents or electronic publications authorised by the copyright holders to make printed materials and other documents or electronic publications available to the public and reproduce them if a file for download is attached to printed materials and other documents or electronic publications;

6.2.3.3. in the case of republishing of printed works and other documents or electronic publications, the republisher shall make sure that the rights of a copyright subject are not infringed in accordance with the provisions of the Copyright Law;

6.2.3.4. when sending information that supplements the descriptions (metadata) of printed materials and other documents or electronic publications available in the Digital Library, the registered and unregistered reader of the Digital Library shall transfer his/her property rights to the supplements to the description of the printed materials and other documents or electronic publications to the NLL;

6.2.3.5. The registered and unregistered reader of the Digital Library shall be prohibited from using the services of the Digital Library if he/she does not accept the scope and type of the Digital Library services available to the registered and unregistered reader of the Digital Library, as well as perform any actions aimed at damaging or otherwise endangering the Digital Library services;

6.2.3.6. The NLL shall not take responsibility for the content published by the registered and unregistered readers of the Digital Library (comments, OCR corrections) and reserves the right to delete this content in the Digital Library's services if it does not comply with the Digital Library's content goals or best practice behaviour on the internet;

6.2.3.7. The NLL shall reserve the right to make changes to these Terms regarding the Terms of Use of the Digital Library, if necessary;

6.2.3.8. Questions about the services of the Digital Library or the Terms of Use of the Digital Library of these Terms should be addressed by sending them to the NLL informative e-mail – info@lndb.lv.

6.3. Terms for Awarding the Honorary Reader title set out the requirements that only apply to granting the Honorary Reader title:

6.3.1. The Honorary Reader title shall be awarded in accordance with the written submissions/recommendations of the heads of NLL structural units and based on the decision of the NLL administration;

6.3.2. The Honorary Reader title shall be awarded to:

6.3.2.1. the long-term readers of the NLL who have been using the NLL services for at least 10 years and have given support in improving the NLL work;

6.3.2.2. the long-term employees of the NLL, who have worked for the NLL for at least 20 years and have terminated their employment relations with the NLL;

6.3.3. An honorary reader shall be issued a reader's card, which entitles one to use a free Personal Subscription and get acquainted with printed materials and other documents or electronic publications in the reading rooms of the National Library of Latvia;

6.3.4. The Service Development Council of the NLL may adopt or cancel a decision on granting the title of Honorary Reader in special exceptional cases in accordance with the proposal of the NLL administration.

[1] The personal data of the NLL reader shall be entered into the library information system Aleph500, whose controller is the Cultural Information Systems Centre (CISC). Acquisition and processing of personal data shall be necessary to provide NLL services to the NLL readers. Acquisition and processing of personal data shall take place in accordance with the Personal Data Protection Law and other laws and regulations in force in the Republic of Latvia, as well as in accordance with the Terms of Use of the Aleph500 Library Information System.

[2] The special collections consist of historical materials and novelties of national significance, rare book collections and manuscripts, audio and video recordings, music, art, images, photographs, maps, small print, industry materials about Latvia and the Baltics. Most of the materials of the Special Collections in the NLL collection are in one copy, therefore these materials should be handled with special care to ensure their preservation.

[3] The collection of audiovisual publications includes sound recordings, video recordings, multimedia publications, as well as various sets of language teaching aids, industry books and magazines.

[4] Archival copy – a permanent copy of all types of publications published in the country or a region thereof, which is not issued outside the library. An archival copy is a mandatory copy that the NLL receives in accordance with the Legal Deposit Law in order to ensure the life-long preservation of Latvian publications.

[7] Issuance and receipt of printed materials and other documents or electronic publications between the Latvian and foreign libraries. 

[8] The Personal Loan provides for the right of use for certain categories of readers (specified in Paragraphs 5.2.3.1.–5.2.3.9) to the use of the NLL collection printed materials and other documents (audiovisual materials, etc.) or electronic publications outside the library.
